Hit and Run

Background

In 2006 the Board adopted a policy of compensating victims of hit and run.  The Board felt this policy needed to be revisited.

Policy

A violation of AS 28.35.050 (Action of Operator Immediately After Accident) is not a compensable crime pursuant to AS 18.67.  The Board does not automatically consider a person involved in a vehicle accident to be a victim of a violent crime.  If a pedestrian is struck by an operator of a vehicle who then fails to stop the vehicle at the scene of the accident in violation of AS 28.35.050, the Board may consider that to amount to an assault (causing injury by means of a dangerous instrument), and the victim may be considered for crime victim compensation according to the same guidelines as any other violent crime victim.
